Fact Gathering

Witness, Expert and Jury Vetting

Litigators need to have as much reliable information as possible when preparing for trial. Two key factors that can dictate the outcome of a trial are the witnesses called to testify and composition of the jury. 

UHY Advisors’ Global Business Intelligence and Investigations group has extensive experience screening expert and fact witnesses who will testify on behalf of our clients to ensure that undisclosed facts about the background of any witness does not cause the individual’s testimony to be discredited or excluded.  We also conduct extensive background investigations of witnesses called by the opposing parties to identify weaknesses in their credibility, such as criminal history or undisclosed conflicts of interest, as well as to identify conflicting prior statements or testimony.  We also provide jury screening services that allow litigators to have sufficient information to exclude jury members who may be prejudiced against their clients or who may have conflicts of interest.

Digital Forensics

The use of electronic communication and digital storage has become a critical component of conducting business today.  Almost all workers – from the CEO to the copy room employee – utilize technology every day to transfer, collect and organize information.  As a result, when disputes arise, some of the most fruitful places to obtain answers are in the hard drives, servers, databases, emails and mobile devices of the individuals and entities involved. 

UHY Advisors’ professionals were involved in some of the earliest private digital forensic investigations and continue to be leaders in this industry. Our experience in recovering and analyzing “deleted” digital evidence using state-of-the-art procedures that preserve chain-of-custody, coupled with our deep understanding of legal and strategic factors in litigation, has helped to position UHY Advisors as a major player in the digital forensics field. 

For example, in a recent litigation support investigation, our digital forensics experts uncovered evidence that two former employees of a company had been using company computers and mobile devices to misappropriate company trade secrets and to remotely access client lists in connection with their formation of a new competing business.  Information set forth in an affidavit of UHY Advisors’ forensic experts led a Federal judge to issue a temporary restraining order against the suspect employees, after which they promptly settled the case.
